A. Types of Manipulation

We ultimately identify three types of trading strategies that generate affirmative answers to our four foundational questions. Each, in our view, should be banned as a type of illegal manipulation, but in each case the ban requires appropriately designed enforcement procedures relating to burdens of going forward and persuasion as well as to appropriate evidentiary presumptions. These three trading strategies are not necessarily exhaustive of the types of trading strategies that should be banned under the Exchange Act as manipulative, but the list represents a reasonable distillation of the types of manipulation cases that have come up so far under the Exchange Act regarding which we think a ban is justified.
